By accessing or using flshbckz.com (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

We reserve the right to update these Terms at any time. Material changes will be notified via email or in-app notice. Continued use after changes take effect constitutes acceptance of the new Terms.

flshbckz is a digital disposable camera platform for events. Event hosts create a “film” — a shared photo album with a QR code or link. Guests scan to join anonymously and take photos through their phone browser. Photos remain hidden until the host reveals the album.

After the album lifespan expires, photos are permanently deleted. Paid tier duration is tied to the specific plan purchased.

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have obtained parental or guardian consent.

Event hosts must provide a valid email address for authentication. Guests do not need an account — they participate anonymously.

Host accounts are created via email magic link through Supabase Auth. You are responsible for maintaining the confidentiality of your account access.

You may delete your account at any time by contacting hello@flshbckz.com. Account deletion removes your personal data and access to hosted events.

Paid plans are processed through Stripe, our PCI-compliant payment processor. We do not store or have access to your credit card details.

You agree not to use the Service for:

• Uploading illegal, abusive, harassing, or explicit content without appropriate consent
• Impersonating another person or entity
• Attempting to disrupt, compromise, or reverse-engineer the Service
• Uploading content that infringes on third-party intellectual property rights
• Using automated tools (bots, scrapers, scripts) to interact with the Service beyond normal usage

We reserve the right to remove content and suspend accounts that violate these rules.

Hosts retain full ownership of the photos uploaded to their events. flshbckz claims no ownership over your content.

By uploading photos, you grant flshbckz a limited, non-exclusive license to store, process, and display those photos solely for the purpose of operating the Service (e.g., applying film filters, serving photos to event guests, generating album views). This license expires when the event is deleted or the album lifespan ends.

Guests who submit photos grant the event host the ability to view and share those photos within the event, subject to the event's privacy setting (“private” or “shared”).

Your use of the Service is governed by our Privacy Policy. Key points:

• Guests are fully anonymous — no names, emails, or identifiers collected
• No advertising cookies or third-party tracking pixels
• Photos are stored encrypted at rest and transmitted over HTTPS
• We do not sell your personal information

Event data (photos, guest tokens, event settings) is retained for the duration of the album lifespan (24 hours on Free, up to 90 days on paid plans). After expiry, photos are permanently deleted from our systems.

Hosts may delete an event at any time through the dashboard. Deletion removes event records, guest tokens, and photo database entries. Photo files stored in Supabase Storage may persist briefly until a cleanup job removes them.

Account authentication data is retained until you request account deletion.

flshbckz relies on the following third-party providers:

• Supabase — Database, Authentication, File Storage
• Stripe — Payment Processing
• Netlify / Digital Ocean — Hosting
• PostHog — Product Analytics (privacy-friendly, no cross-site tracking)

Each provider operates under its own terms of service and privacy policy. We select providers that align with our privacy commitments.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” flshbckz MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE RELIABILITY, AVAILABILITY, OR SECURITY OF THE SERVICE.

We strive for high uptime and data durability, but we do not guarantee that the Service will be uninterrupted or error-free. You use the Service at your own risk.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, flshbckz SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim arising from these Terms or the Service is limited to the amount you have paid us in the twelve (12) months preceding the claim.

We may suspend or terminate your access to the Service at any time, without prior notice, if you violate these Terms or if your use poses a risk to the Service or other users.

Upon termination, your events and photos will be deleted in accordance with our data retention policy. If you believe your access was terminated in error, contact hello@flshbckz.com.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any disputes arising from these Terms shall be resolved in the courts of Delaware. If you are a consumer in the EEA or UK, you may also have the right to bring proceedings in your home country.
